This Virtual GiftPlusCard is issued to you by HDFC Bank Ltd, a banking company incorporated under the Companies Act, 1956 and licensed as a Bank within the meaning of the Banking Regulation Act, 1949, having its Registered and Corporate office at HDFC Bank House, Senapati Bapat Marg, Lower Parel, Mumbai – 400 013 (“HDFC Bank”).

(Terms &Conditions) These terms and any attachments or accompanying supplement(s) shall also include the terms and conditions provided on the HDFC Bank’s website viz.[](together "the Terms”) and shall govern the usage of the Virtual GiftPlus Card (the “Card”).The words ‘purchaser’, ‘I’, ‘me’ and ‘my’ refer to the purchaser of the Card and the words ‘Cardholder’ means the person to whom the Card has been delivered by the purchaser for use. The term ‘we’, ‘us’, ‘our’ shall include both purchaser and Cardholder. The purchaser shall be responsible to notify the Terms to the Cardholder and ensure that the Cardholder has read and understood the same thoroughly. The Cardholder hereby agrees to abide by the Terms and the Cardholder shall be deemed to have unconditionally agreed to and accepted the Terms by performing a transaction with the Card or acknowledging receipt of the Card in writing and agrees to comply with all the relevant notifications/ guidelines/ circulars issued by the Reserve Bank of India/ any other competent authority / statutory or regulatory body/ies governing the issue and use of Card. The Bank disclaims all liability on account of any breach by the Cardholder of the in the relevant notifications/ guidelines/ circularsgoverning usage of Cardsin force and from time to time.

(Accessing Card Account Detail) Information concerning the Card, including the available balance (“Card Balance”) and Card history can be viewed online at after due log-in or accessed by calling/writingto the Customer Service Centre at the phone number and/or email address mentioned below.

1.Usage,Loading, Limits and Security
(Usage) The issue and use of the Card shall be subject to the rules and regulations as issued by HDFC Bank from time to time. The Cardholder shall use the Card only in India for electronic purchase of goods and services through e-commerce websites. We further understand and acknowledge that no cash withdrawal, cash-out, refund or fund transfer will be permitted on the Card. The Cardholder will be responsible for all the transactions processed by use of the Card and shall accept the HDFC Bank’s record of transactions as conclusive and binding for all purposes.

We understand and acknowledge that the Card is not reloadable.  Any discrepancy, if any in relation to the balance amount available on the Card will be taken up directly by the Cardholder with the purchaser and, HDFC Bank will not be responsible for the same.

(IPIN) We understand that HDFC Bank will allot an internet personal identification number (“IPIN”) to enable us to carry out transactions and to access the Card Balance online. We shall memorise the IPIN and destroy the IPIN mailer immediately. HDFC Bank shall not be liable for any loss by the misuse of the Card.We agree that the IPIN regeneration request and hotlisting request will be taken only by phone banking and the reissued IPIN will be delivered to mailing address of the purchaser by the Bank.

(Legalities) The Cardholder shall only use the Card for lawful purposes in a lawful manner.

(Use by Third Party)To protect the interest of Cardholder from un-authorised use it is advised that you shall keep the Card under your personal custody at all times.

(Cards)Cards are treated like cash, and HDFC Bank shall not be liable for the misuse, loss or theftof Cards.

(Responsibility)HDFC Bank shall not in any manner be responsible for any disputes regarding goods and services received by the Cardholder including the quality, value warranty, delay of delivery, non delivery, non receipt of any goods or services. It must be clearly understood that the Card is only a facility to the Cardholder to avail facilities and the Bank holds out no warranty or makes no representation about quality, quantity, value, delivery or otherwise, howsoever regarding goods or services, and any such disputes should be resolved by the Cardholder with the merchant directly.

(Changes in Card Balance)The Customer may be entitled for refund in case of reversal of transaction and no cash shall be refunded to the Cardholder. HDFC Bank shall recover applicable charges imposed by the respective merchant while refunding the money.

(Transaction Limits)HDFC Bankand/or e-commerce merchants may set limits on the monetary amount and number of transactions allowed through a Card during a set time period ("Transaction Limits"). Transaction Limits are set out in the supplement and will apply to the Card. HDFC Bank may, at any time, modify the Transaction Limits for any reason whatsoever. The Cardholder can view these changes online at or may also call the customer service centre (”Customer Service Centre”). The Cardholder will be notified in accordance with applicable law.

2. Expiration, Cancellation and Termination
The Card issued to you is valid upto the last working day of the month indicated on the Card. HDFC Bank may cancel or suspend usage of the Card immediately upon: (i) a request being made by the Cardholder. (ii) any breach of terms and conditions by the Cardholder, or (iii) HDFC Bankis unable or otherwise prevented from processing payments in relation to the Card for reasons beyond its reasonable control, including but not limited to restrictions imposed by law or regulation. We agree and confirm that any unclaimed balance amount will be transferred to the Depositor Education and Awareness Fund Scheme as per Reserve Bank of India guideline dated [March 2014].

3. Card Balance
(Card Balance) The Cardholder may utilise the Card Balance by due and proper use of the Card, in accordance with the Terms. No interest is payable to the Cardholder.The card holder is advised to transact for requisite amount of purchase /availing services including applicable charges otherwise the transaction may not be honoured.

(Irregularities)In case the Cardholder finds out that a wrong entry has been debited to the Card, he will within 07 days of such entry being recorded raise the issue with HDFC Bank.  We understand that HDFC Bank will do a thorough investigation of the same and revert to us with their final findings and decision of HDFC Bank shall be final and binding on us.

4. Fees and Applicable Taxes
HDFC Bankwill deduct all fees and charges due to HDFCBank from the Card Balance.

5.Liability of HDFC Bank.
The Liability of HDFCBank is restricted to the extent of the amount lying in the card at any point of time.
The internet per-se is susceptible to a number of frauds, misuses, hacking, phishing and other actions which could affect use of the Card. HDFC Bank shall aim to provide security to prevent the same, but HDFC Bank shall not guarantee the Cardholder for such internet frauds, hacking and other actions which could affect the use of the Card and the same shall be borne by the Cardholder. The Cardholder shall separately evolve/evaluate all risks arising out of the same.

HDFC Bank shall not be responsible for interception/ misuse of the Card over the internet or any other medium. HDFC Bank shall not be liable if the Card falls into wrong hands / used fraudulently due to any reason whatsoever.

The Cardholder accepts that at his request and risk HDFC Bank has agreed to provide him the Card and accepts full responsibility for all transactions recorded by use of his Card.

The Card is governed by the guidelines/regulations issued by the Reserve Bank of India and is also subject to directions/instructions issued by the regulators from time to time in respect of refund, repayment, usage etc. and HDFC Bank is not responsible or liable for any violation by the Cardholder of applicable law. All transactions done by using the Card are subject to applicable Indian laws. Cardholder shall not use the Card for any unlawful activity. By purchasing or using this Card, the Cardholder hereby declares that his/her name does not, at any time, appear in the consolidated list of Terrorist Individuals Organizations as circulated by the Reserve Bank of India from time to time.

We agree and confirm that HDFC Bank shall not be responsible for any content being sent/shared by the purchaser to the Cardholder (along with the Card) in any form whatsoever and the Cardholder agrees not to hold HDFC Bank liable for any content sent to the Cardholder by the purchaser. Further the purchaser and the Cardholder shall indemnify HDFC Bank for any loss or harm caused to HDFC Bank and its officers/employees on account of any inappropriate content being sent by the purchaser to the Cardholder.

The purchaser agrees and confirms that HDFC Bank shall not have any liability towards the purchaser/Cardholder in case the Card is delivered by the purchaser to an email address not intended by the purchaser.

6.Data Protection
HDFC Bankwill process the Cardholders personal data to administer the Card, to deal with any queries the Cardholder has concerning the Card or its use, for statistical and regulatory reporting and fraud prevention purposes.

HDFC Bank will confidentially and only to the extent permitted under applicable data protection and bank secrecy laws, provideCardholders information to HDFC Bank group of companies and third parties including those providing application processing, fraud monitoring, customer service, card production and technology processing services and each of their agents and subcontractors, information about the Cardholder and the Card.

HDFC Bankmay disclose the Cardholder’s personal data to:  (i) fraud prevention agencies if false or inaccurate information is provided and fraud is suspected, and (ii) statutory / regulatory authorities, law enforcement or fraud prevention agencies where HDFC Bank is required to do so by applicable law or court order. HDFC Bankmay record and/or monitor telephone calls to help maintain high quality service and for security, data collection and training purposes, or as required by applicable law. All recordings belong to HDFC Bank. The Cardholder consents to the processing (including transfer) of its personal data by HDFC Bank, and the other recipients identified above, for the purposes set out above.

(Amendments) HDFC Bank may, with notice to the Cardholder, at any time and subject to applicable law, change or delete any provision, add or change to the Terms. This includes the right to add or change (including to increase or decrease) any charges. The Cardholder will be deemed to have seen and accepted the changes 24 hours after they are available online at HDFC bank reserves the right to amend any conditions.
(Governing Law)These Terms and all matters arising hereunder shall be governed by Indian laws and both the Cardholder and HDFC Banksubmit to the exclusive jurisdiction of the courts of Mumbai.
